Unauthorized Practice

The practice of denturism is regulated in British Columbia under the Health Professions Act, R.S.B.C. 1996, c.183 (the "Act"), and by the Denturists Regulation, B.C. Reg. 277/2008 (the "Regulation") made under the authority of the Act.

Under section 13(2) of the Act and section 5 of the Regulation, no one other than a registrant of the CDBC may carry out non-surgical intraoral procedures to make or furnish complete dentures, overdentures or partial dentures.

Section 13(2) of the Act provides as follows:

Prohibitions regarding practice of designated health profession
13  . . .

(2) If a regulation [for a designated health profession such as denturism] prescribes a service that may only be provided by a registrant of [that] particular college,
(a) a person other than a registrant of the college must not provide the service, and
(b) a person must not recover any fee or remuneration in any court in respect of the provision of the service unless, at the time the service was provided, the person was a registrant of the college or a corporation entitled to provide the services of a registrant of the college.

Section 5 of the Regulation states that:

Restricted activities
5 (1) No person other than a registrant may carry out non-surgical intraoral procedures to make or furnish complete dentures.

   (2)  No person other than a registrant who meets the additional qualifications established in the bylaws may carry out non-surgical intraoral procedures to make or furnish overdentures and partial dentures.

Unauthorized practice occurs when a person, who is not licensed with the College of Denturists of British Columbia or the College of Dental Surgeons of British Columbia, engages in the above noted restricted activities. Unauthorized practice presents a grave danger to the public and will not be tolerated.
